Legal Question in Employment Law in North Carolina

I am a contracted employee for a electronic health record software company, I am a technical support person, I work from home but have to answer the phone 8am-10pm 7 days a week and do research for my boss through the day, the phone does not ring all day but I cannot do anything because I have to answer. I am only making $1000 a month so it breaks down to .39 cent an hour. Is this legal?

It depends on what you are, unfortunately not enough information was given in terms of legal terminology. If you are considered an independent contractor and not an employee, there is no minimum wage requirement. If you are an employee that receives a w-2 at the end of the year, the employer is required to follow minimum wage laws except for limited circumstances. I recommend you consult with an employment lawyer in your area and/or contact the NC Department of Labor
