Legal Question in Landlord & Tenant Law in North Carolina

I have been given an eviction notice in the state of NC. for nonpayment of rent. I have a court date for next wed. 7/28. Do I have recourse? If I pay before court can I still be evicted? I have applied for another apt and have been notified that this apt community has already registered me as evicted which ruined my chance to be accepted; is this legal before a court hearing. If not can I sue?

You can pay the back rent plus the court costs at any time beforee the hearing and the case will be dismissed. You will not be evicted.

If you want to stay, you can always appeal, but you must post bond in an amount equal to past due rent and promise to pay the rental into court. Otherwise, you have 10 days to get out.

And it is legal - the landlord is seeking to get you out for non-payment of rent. There is no defense to that - you have either paid or you haven't. If you pay, then get the landlord to remove the information. What are you going to sue for?
