Legal Question in Legal Ethics in North Carolina

My divorce lawyer required a $10,000.00 retaining fee. The expenses for his services only came to $2800.00. When I asked for the rest of my money back he informed me that it was in escrow and that i couldn't have it back but that is could use it if I ever needed his services again. He has recently been disbarred and I was wondering if there was a way to get my money back from him?

There should be a way to get your retainer back, either from the lawyer (and his trust account), or possibly from a fund designed to cover such losses.
