Legal Question in Personal Injury in North Carolina

my son and his girlfriend were in an automobile accident in 08 in the state of NC, it was the other drivers fault and they hired an attorney. her car was totaled - all they did was pay it off, and she was left without a vehicle. the lawyer said that is all the insurance company had to do. neither one of them had health insurance and haven't been released from the doctor's yet because they do not have the money to pay him - and he charges interest. they are coming up to the 3 yr mark of the accident and were told that if they don't do something they will no longer have a case, is this true? Also they are very disatisfied with the lawyer and feel that they have not helpd them - is it too late to get another lawyer?

There is a 3 year statute of limitations on car accident negligence. Don't wait until the 35th month to get a new lawyer. No lawyer wants to file a lawsuit that late when he just go involved in the case.
