The value of your case, and that of your spouse, is very difficult to evaluate with further information. This would include the exact amount of medical bills and lost earnings. It would also include any future lost earnings. This claim is also complicated due to the possibility of a "lien" against the settlement proceeds, and you will have to determine the insurance limits available for you. The insurance includes the other driver's liability limits, as well as your own underinsured motorist limits (if any). In general, you would be entitled to past and future lost earnings and medical expenses, as well as pain-and-suffering; you may, however, as a practical matter be limited to the insurance proceeds available. You probably need to contact an attorney to discuss the specifics of your claim in further detail.
