Legal Question in Product Liability in North Carolina

bodily injury

the company in question has asked us to give an amount we would like to receive for the injury to our son's foot (his heel was cut and a peice of it needed to be reattached, he was 8 months at the time). we are unsure of the amount to ask for, they have agreed to pay medical bills and replacement costs for the dishwasher. we just need to know what our son's rights are for pain and suffering reimbersment.

Re: bodily injury

Yikes. That's a very tricky question. It would depend on the scarring, and whether there is (or might be) any permanent injury. There may also of course be issues of liability; i.e., the product manufacturer may or may not be liable at all. You should consider contacting an attorney. If the settlement is not "court-approved," then your child would theoretically be able to sue later, and his statute of limitations does not run until he is 18 years old.
