Legal Question in Real Estate Law in North Carolina

A property I own and was renting has been severely damaged by negligent tenants, who after 3 months of failure to pay rent have finally been evicted. I live out of state and the property was being managed by a Property Management company I hired.

I have lost a lot of money and my property has been devalued.

What is my legal recourse?

It depends on who you want recourse against.

If its the property manager, it will depend on the management agreement between the two of you. If the agreement did not require regular inspections, there probably is no recourse against them.

If its against the tenant, you have a few things to consider.

1. If the damage was severe and intentional, they have committed a crime and you can call law enforcement.

2. You can sue the tenant for any damages above the security deposit. But if the tenants have little or no money, suing my be an empty gesture as you would get a judgment you would likely never collect.
