Legal Question in Wills and Trusts in North Carolina

Transfering of money

My father has been diagnosed with dementia and it is clear that he will be in a nursing home in 1-2 years. ALL of his assets are in his name and we need to move them ASAP out of his name. If we do not move them, the nursing home/gov't will eat up all of his assets. I am looking for a VERY creative attorney that can help our family with this matter. He does not have nursing home insurance. His wife is alive and he has 2 children.

Re: Transfering of money

Your question requires a medicaid specialist. You should not proceed without the written advice of a medicaid specialist. While not presently being enforced by the current administration, transfer of assets for the purpose of medicaid eligibility is a federal felony, so you should proceed with extreme caution.
