Should I have my will drafted in the US or Canada?

Where do you live and own property? It may not be an either/or but both. You will need a Canadian will if you own property in Canada in order to transfer ownership of the property. You will need a North Carolina will for any property in NC.

I may be able to help with the NC will depending on the size of your estate. If you have a multi-million dollar estate with assets in both NC and Canada, then you will need to consult with attorneys who specialize in cross-border estate planning.

There are tax considerations for both the US and Canada (I am not licensed to practice law in Canada) and if you have the good fortune to have a multi-million dollar estate you will have these considerations to worry about.

Beyond that, where do you live? What do you own and where is it located? For example, if you only have a Canadian bank account, maybe you do not need a will there.
