Legal Question in Criminal Law in North Dakota

Companies writing out bad checks, can they be prosacuted crimminally or would it

I was wondering if a companey issued a Closed Account check, would that check be sent to the states attorney or would it something that would go civil, since it is a business and not a person? Also, if a person is held criminally responsable would it be the signer of the check or the business owner?

If you could respond via email that would be great.

thanks in advance,

Amanda

Re: Companies writing out bad checks, can they be prosacuted crimminally or woul

The answer to your question is governed by who received the money. If an individual knowingly issued a bad check and received the proceeds, the individual could be prosecuted even though it was a company check.

One assumes that would be the business owner or the chief financial officer.

If no one directly performed a criminal act, the matter may be processed through the civil justice system.
