Legal Question in Credit and Debt Law in Ohio

3 years ago my husband cosigned for a car for someone (without me knowing). Payment wasn't made after about a year and car was repossessed. The car had depreciated I believe so there was a balance left. My husband received a collections letter today for $5,384. Question is, what is his (our) responsibility? He works as a waiter so bimonthly paychecks (hourly wage only, tips are cash) are about $120 each. I own a business making $100k a year. Husband's name is not on my business, our house, our cars, and no utilities are in husbands name (all mine). We do have a joint checking account. Can they take the money from me because I am his spouse? Thanks in advance.

You are not responsible for the debt. Get your husband off the joint account ASAP. It appears that he does not make enough money to be garnished.

You are not going to be responsible for any of the debt.
