Legal Question in Criminal Law in Ohio

Auto Accidents

Is a Car accident in the state of Ohio that is not a hit and run accident considered an accident or a homicide? Using the forensic definition of homicide of death at hands of another does this apply to a auto accident? Thanks, Kate

Re: Auto Accidents

Whether an accident is considered a homicide is up to the local prosecutor after he reviews the facts. Then a jury makes that determination.

If you want a more thorough evaluation I need to know more facts.

Re: Auto Accidents

You really have not provided enough fact but if you hit and killed someone with your car, the prosecutor will most likely bring charges relating to homicide. If it was an accident but you were negligent in some way, most likely it will be vehicular manslaughter. THat is just one of the charges that can be brought. Feel free to call me with any questions.
