Alimony

I would like to know if i would be able to get alimony after my divorce in january of 2003. and what i would need to do. at this time i am homeless and unemployed and my husband has me on his insurance for medical due to the fact that i am a diabetic, but he said he will be taking me off all insurance. He also now lives with another woman and her children, we have a dauther in college who he don't take care of. we have also filed a bankcuptcy chapter 13, He left us homeless and with no place to live or no income i am staying with my sister at this time while looking for a job.

The length and amount of spousal support in a divorce case depends on the length of marriage, the standard of living of the parties before the filing of divorce, and the relative fault of the parties, if any. You need to present evidence to the court of your present situation, whether you have been able to support yourself in the past, and the standards of living that you had while you were married. It would also help if you could show that your husband has or had large financial resources, and frittered them away. Your attorney should be helpful in this regard.
