Legal Question in Family Law in Ohio

A friend of mine had a baby last year after purposefully getting pregnant not knowing who the father would be. A boyfriend she had late in her pregnancy, who is no longer around, insisted on signing the babies birth certificate. Now she needs help and has filed for assistance but in order to qualify they want her to file for child support. Obviously the guy is going to ask for a paternity test. What happens then?

When seeking assistance, mom must fully cooperate with all agencies involved, including child support. Signing the birth certificate- and only the birth certificate- does not establish paternity. Signing the Affidavit of Paternity at the hospital (or anywhere else) and the filing of it would establish paternity. After a certain time period, it is very difficult to challenge the Affidavit of Paternity. If an Affidavit of Paternity was signed- and depending how long ago it was signed- a child support agency may not be able to order paternity testing.
