Legal Question in Family Law in Ohio

I have a husband who is verbally and sometimes physically abusive. We are not divorced yet but I am trying to get sole custody of our five month old daughter. He is an alcoholic and mentally unstable. I believe she will be in grave danger if he recieves any type of unsupervised custody. What can I do to stop this from happening?

In ohio when you file for divorce the court will set up a temporary custody visitation plan. If you put on evidence before the court that your husband is a danger to the child the court believes the evidence then the court will probably only allow for supervised visitation with him. But there are no guarantees as to how the court will rule. Much will depend upon the nature of the evidence that you present in the magistrate or judge making the decision.
