Legal Question in Family Law in Ohio

mother had sole custody but father's parents took custody of child declaring her unfit due to being underage without going to court taking advantage of her age and lack of knowlege refusing to return the baby. Can the father be prosecuted for supporting this action?

In Ohio, if there is no court order (usually this would come out of a juvenile court) then the people who took the child from the mother would need to return the child upon demand. If they did not, then the mother could go to law enforcement and file criminal charges. Sometimes in these situations, the police will tell you that this is a "civil matter" and must be handled through the courts. In that case, you would want to hire an attorney to file something with the court and get a court order establishing who has the right to custody.
