Rights of underage mothers

I would like to know if my 16 year old niece has the right as a new mother to leave her mothers residence. She is living in the basement of her mother's boyfriend's house. The boyfriend does drugs, and has been convicted on drug charges with the mother in the past. He also has at least one domestic violence charge. The boyfriends mother takes WIC coupons for the house. The baby's father is rarely allowed to see the child, although their has been no problem and he does pay child support. She would like to leave for a better environment for her baby.

She has an obligation to the child to provide a safe environment for the child. If she does not do so she could have the child taken away by the childrens services bureau.
