Unless you have a contract (union collective bargaining agreement) you can be fired for any reason that is not illegal. The illegal reasons are race, sex, religion, handicap etc. Most employers are not so dumb that they would ever tell you your being fired because you're too old. Most employers would make up some other reason like being unfriendly to disguise their real purpose. You need evidence though not just suspicion. Have they been firing a lot of older employees and replacing them with younger people? In order to make an age discrimination you have to be older than 40.

If that is the true reason, yes. However, sometimes employers want to force people out for unlawful reasons. To make it appear lawful, they make up some or benign reason which is pretext for unlawful discrimination. Often times, good employees who have been working some for decades suddenly become bad employees when they're getting close to retirement, have a pension that's going to vest, etc. Currently, I represent a manager who worked for a well-known grocery chain for nearly 30 years. She was terminated under similar conditions and we're pursuing an age discrimination lawsuit in Federal court. Please call me for a free telephone consult.
