Legal Question in Landlord & Tenant Law in Ohio

I am the holder of a lease for a two bedroom apartment. I have been subletting the spare bedroom to the same person since November of 2012. Unfortunately, due to some personal issues I no longer want her living with me. She is not on the lease. I asked her to vacate the apartment within 30 days. If she does not comply, what are my options?

In Ohio, R.C. 5321.17 governs the terminations of month to month tenancies and requires the landlord (in this case that would be you since you are renting to her even though you are a tenant yourself) to give the tenant 30 days notice of the termination of the tenancy. However, that notice only starts to be calculated from the start of the next rental period. So if you gave her the notice in March, you would have to wait until the end of April before you could start an eviction proceeding.
