Legal Question in Landlord & Tenant Law in Ohio

I Have a person who lives in a rental i have but did not sign a lease paper or has any mail or utilities in his name at that address .Can i kick him out of the apartment with out going to court ? He refused to pay anything to stay there on the 1st of this month but the water was shut off because i didnt have the money to pay it .this is an ohio residence .

In Ohio, a lease agreement can be oral or in writing, or can arise by implication from the actions of the parties. The safest way to proceed would be to file a statutory eviction so that you will not run afoul of the prohibitions under R.C. 5321.15.
