Legal Question in Legal Ethics in Ohio

Employee Evaluations

A new competency requirement, that would be used collectively with others, has recently been added to our employee evaluations. The competency is joining a health wellness program offerred through employee services. There is a fee attached ($20.00) and blood work and a personal Heatlh assesment form must be completed by all who choose to participate. Although we are told this is not mandatory if we refuse to participate we will lose that competency point on our evaluations. Is this fair, any legal implications here? Thank you.

Re: Employee Evaluations

Ohio is an "at-will" employment state - unless you have a specifice contract otherwise, or are subject to union bargaining. "Fairness" and "legal" are two different things. The requirement does not discriminate nor is it against "public policy" - on the contrary, it appears good for both employer and employee.
