Legal Question in Wills and Trusts in Ohio

Contest power of attorney

My dad died this month and is leaving his assets to an adopted niece. Can I contest this, and if so, how?

Re: Contest power of attorney

First off, please accept my condolences on your loss of your father.

I am unclear whether you are in Ohio or Washington, and where your father died. I am not licensed in Ohio, so I cannot speak for the law there.

In Washington, if a will is properly executed, the decedent can make whatever bequests he or she chooses, even if that includes disinheriting children and leaving everything to somebody completely different.

If you suspect that this was not your father's intention - if you think he may have been unduly influenced, or if you have questions about the validity of the will, or if you think he may not have been competent when the will was executed, then you should contact your local Bar Association for a referral to an attorney who handles probate in your area.

They can review the will and discuss with you your issues with what appears to be happening.

I hope this helps. Powell
