If I am executor on my Mothers will-but my brother has his name on my Mothers bank accounts..will my brother get in trouble if he takes her money after her death?

If the account is held jointly with your mother and brother, then it will pass directly to him upon your mother's death. He will not get into trouble for taking the money unless you can prove that he coerced or tricked your mother into putting his name on the accounts. This would have to be proved in a court proceeding.
