Inhertance to a person on Medicare / Medicad

My father is in a nursing home and Medicare / Medicad is paying the for the expenses. My mother has power of attorney. My fathers mother passed just recently and he was one of the benificiaries. Can he give the money to my mother or me (his daughter) as a gift or do we have to give the monies to the nursing home or the state for Medicare / Medicad?

Does anyone have a durable power of attorney for your father? If so, does that dpoa allow the attorney-in-fact to disclaim an inheritance. If it does, the attorney-in-fact should disclaim the inheritance. However, that is no guarantee that you or your mother will get the bequest.
