In Oklahoma, in order for the Court to have jurisdiction over your case you must have been a resident of this state for at least six (6) months, and a resident of the county in which you are filing for at least thirty (30) days prior to the Petition being filed.

WAIT -- I failed to note in your header that you were asking about legal separation, rather than dissolution of marriage. There is no specific statutory residency requirement for jurisdiction to attach in a legal separation action. My apologies for any confusion.

If you are currently a resident of the State of Oklahoma, you may file. You may face a jurisdictional challenge, but in most cases I believe jurisdiction would be upheld. Of course, many circumstances will control the ultimate result; if you would like to file, I would suggest retaining legal counsel.
