Legal Question in Family Law in Oklahoma

marriage after divorce

In Oklahoma you have to wait 6 months after the divorce is final to get married again. If you marry in another state before the six months is over, will Oklahoma recognize the marriage?

Re: marriage after divorce

No. For the remainder of the 6 month prohibition, the marriage will not be recognized as valid. In addition, a subsequent marriage entered into prior to the expiration of 6 months is viewed as "voidable", and either party may seek an annulment of the marriage due to the restricted party's incapacity to enter into a valid marriage. However, following expiration the 6 months prohibition, and assuming the parties are still together, the marriage will be recognized (as the incapacity will have been removed).

You should also note, however, that a person who remarries prematurely in another state then returns to Oklahoma and cohabits with his/her new "spouse" could face criminal charges for engaging in bigamy.
