Legal Question in Criminal Law in Oklahoma

Sentencing

Is 130 years the right sentence for Robbery in the First Degree? The lawyer we paid was not present in court when my sister was convicted. She has been in for 5 1/2 years. Is there anything my family can do?

Her parole hearing is scheduled for August 2009.

Re: Sentencing

Absent extraordinary circumstances, there is nothing you can do. If there has been a direct appeal, she would have had to file for habeas relief within 1 year and 90 days from the decision on her direct appeal. At this point, parole is her only likely prospect for getting out before serving 85% of her time. Contact your legislator if you want change in this arena. At the rate this sate is going, we may as well just lock everyone up and be done with i.

Good Luck,

Chad
