Legal Question in Insurance Law in Oklahoma

I had been drinking at my house with a friend when he wanted to go to the liquor store and as we left, he turned left onto the street before I got my seat-belt fastened. I fell out the door to the right onto the pavement.The police took him to a detox instead of giving him a D.U.I. and I was escorted to a hospital where they gave me a head x-ray and stitches above the eye and treated me for scrapes. Anyway I received a bill from the hospital for $8,138.96 and told by his insurance that I was cognizant of his condition before I left the house and have no claim on his insurance for the bill. Is this correct?

Based on what you described, I would suggest arguing it with the insurer. There are some unstated facts that could swing it one way or the other, for example, what specifically his insurance policy says, what the police report says, etc.. I'd suggest talking with an attorney with all the facts and details.
