Legal Question

Work and Drug testing

I failed a drug test 2 yrs ago and my job sent me to a counselor who said I was fine. Now 2 yrs later they were suspicious of me doing drugs and confronted me and said that if I dont go to counseling again then I would have to resign. Even though I have passed evey drug test since then, is this legal?
