Legal Question in Medical Malpractice in Oregon

wrongful death

My grandfather recently fell and broke his hip, and had to have a hip replacement. He was perfectly fine the day he left the hospital and sent to the rehabilitation facility which he was supposed to spend around 20 days at before being released to go home. There aparently was some sort of mistake given in instructions on his medication. He was on a heart medication to keep fluid from building in his lungs, something he'd been on for a few years. He wasn't given his medication for this. They say when they realized he hadn't been getting that medication, it was already too late, he drown in the fluid that built up in his lungs. My grandpa didn't have to die, they didn't do what they were supposed to for him. Is this acceptable?

Re: wrongful death

I'm so sorry to hear about your grandfather. It's horrific how many people are killed every year by medical mistakes.

From what you've said, it sure sounds like a valid claim for medical malpractice with an obvious error, but there may be other factors. Hard to say with any certainty until a lawyer digs into the case. How long ago did this occur? The statute of limitations is probably three years for this, although you don't want to wait.

How long was your grandfather off of his heart meds before they figured out the problem? Are you his next of kin? Let us know if we can help.

Best wishes,

-- Sam
