Legal Question in Personal Injury in Oregon

Pedestrian accident, process/compensation?

My boyfriend got hit by a car, he was knocked out unconcious for 3 hours and suffered from a concussion. The person that hit him was arrested with a DUI, Assault III and a hit and run. She was set at $37,500 bail amount. My boyfriend now has a neck injury and definitely needs to seek medical help to fix this. What exactly are we supposed to do? Contact the DMV or the jail/county? We were also wondering how much he would be compensated for. We have never had this happen before, and don't know anyone that has. So we need help! Thank you for any advice that you can give!

Re: Pedestrian accident, process/compensation?

The person who hit your boyfriend will likely have criminal charges filed against him by the appropriate district attorney. The prosecuting attorney will likely contact your boyfriend to obtain his statement. You boyfriend can also contact the county district attorney's to find out the status of any filed charges.

More importantly, your boyfriend has a civil claim against the driver for the damages (economic and nonecomonic) caused to your boyfriend. Your boyfriend should contact an attorney immediatly to assist him. I would be happy to help him and can be reached at [email protected]. My initial consultation is at no charge at which time your boyfriend can decide whether he wishes to retai me.

You should definitely contact an attorney immediately. You have a very significant claim for damages against the driver and the driver's insurance company. You should not agree to any offer given to you by the insurance company or sign any papers they give you, without discussing it with an attorney who specializes in personal injury cases.

I do not handle cases like this but Greg Kafoury and Mark McDougal (in Portland) do. You can reach them at [email protected]. They take cases on a contingency basis, which means you do not pay for their services unless they win money for you.
