Legal Question in Personal Injury in Pennsylvania

I was involved in a motorcycle accident in PA where the other party was at fault. I have substantial injuries and had surgery and a metal implant to repair a badly broken bone along with being out of work for over four months. The other parties insurance coverage is barely enough to cover my medical bills and lost wages. Can I seek compensation from the other party for pain and suffering above his small insurance coverage ?

The simple answer is yes - in motorcycle accidents you can generally always sue for P&S.

The issue will be if he has sufficient coverage - and if not, does the other party have any assets.

You can also check your insurance policy to see if you selected Underinsured Motorist coverage - which could kick in if their insurance isn't enough to pay his claim.

If you choose to sue in court - attorneys will generally review these types of cases for free - and take them on contingency (which means they will collect a portion of the recovery) - most will only take cases that have merit and a chance of recovery due to this fee arrangement.
