Disability Discrimination??

My husb. is a laryngectomee since 4/07. Prior to his illness he was a mgr of a truck rental center. Was on leave most of the year due to setbacks & treatments. Returned to work end of Sept. There were some changes to programs/policies that had been implemented while he was on leave. He was accepted back in the same position, same pay as prior to his leave-the job was held for his return. Now 6 mths later they are forcing him to take a demotion in position & pay or quit-they are stating it is due to one of the programs not being followed-basically they are saying he cannot due his job. No one gave any direct training on these new programs. All he had to count on was what he could learn on his own & his crew. Not being able to speak makes that a slow process. During his leave, his center was pretty much left go-no direct supervision. So he was left to learn from a crew that probably was not sure themselves & an asst mgr that would work against him-that alone is a challenge to hurdle. He has been told that if he chooses the demotion they would find something he could do, lot lower in pay, like clean trucks & storage which to me is degrading his self esteem. He is devastated & feels worthless-his back to the wall-needs the med. ins

It sound like there may be discrimination in that the Employer is failing to reasonable accomodate him by not giving the proper training. It is not necessarily clearcut you should contact an attorney to discuss this further.
