Legal Question in Appeals and Writs in Pennsylvania

Statute of limitations on summary appeals

Is there a time limit on how long the state has to respond to a summary appeal on a guilty charge from a district court on traffic violations? Once you have filed the appeal are there any time restraints on how long the state has to schedule and hold a hearing? Is there a Statue of Limitations on Summary Appeals?

Re: Statute of limitations on summary appeals

You have the right to a speedy trial. Generally, this means that the Commonwealth must prosecute your case within one year. Of course, any delay that you cause is held against you. In my experience, if your summary appeal trial is not held within one year of the date you filed, all charges must be dismissed.
