Do I sue 2 people Seperate or together

I have a rental property where a tenant was behind in her rent. I was going to evict her and a friend of hers wrote me a detailed letter saying that they would pay my tenants past due rent.

The tennant fell further behind in their rent and called me yesterday to say they were leaving.

I figure I can sue both people for the past due rent at this point..True?

Do I sue these people seperatly or together? Note, I never forgave the tennants past due rent when I recieved the note from their friend promising to pay off teh back rent.

Also - The friend only made one payment for past due rent.

First of all, this is not a civil rights question. It's a landlord/tenant or contract question.

It may be argued that you waived your right to go after the tenant if you accepted the offer of the friend. That would be the tenant's argument.

In addition, did you accept the offer from the friend? I would argue that you did, since you cashed one check and didn't go after the tenant.

You can sue both, but you can't collect from both. I would sue them in the same suit. Argue that the tenant owed you the money. And, argue in the alternative that the friend owed you the money.
