Legal Question in Credit and Debt Law in Pennsylvania

Summoned for Credit Card Debt

A brief background of the incident. A few years back, my credit card was stolen along with some of my other stuff, but its the card that's in question. I called right away to have it canceled to find out that the thief had already tried to use it and was denied. Anyhow, they said they would send me a new one and I was relieved. Now, in my irresponsibility, I had been paying online every month and was no longer living in the address on file, so I never received it paper statements or the new card. I am a college student, and fell behind in tuition payments etc., and bottom line is I put it off figuring I'd take the hit and pay back whatever when I get out of school and get a job.

Today, I get a call from my dad saying I was served for the credit card debt, 20 days to respond, etc. I am about 9 days from graduating, have incurred a considerable amount of student loans, and am broke otherwise. I have no assets or anything.

I have been reading various forums to try to get the best advise, as I want to take the most advantageous path. The debt is for 3,075.66, by the way.

I was wondering if someone could give me a step by step process in what I need to do, and what to avoid doing. Any help would be greatly appreciated.

Re: Summoned for Credit Card Debt

I dont know that anyone is going to give you a step by step via this posting method. That is a pretty tall task to ask someone to type that out.

Give me a call at my office or send me an email with a phone number and I would be glad to give a free consult.

If it is a collection agency who is pursuing you rather than the original creditor, you REALLY need to defend the lawsuit.

Re: Summoned for Credit Card Debt

You need to defend this lawsuit. But, you can't do it on your own. You need to hire an attorney who is very familiar with this area of law.

There are valid defenses, particularly if this is a collection agency. Please feel free to email me if you wish to discuss further. Please tell me in which county the suit is filed.
