Legal Question in Criminal Law in Pennsylvania

criminal mischief

i was at a banquet that was held on a golfcourse. later on in the evening myself along w/ 15-18 others took the carts out for a joy ride. of those people, some of them destroyed a few of the carts and no one is coming clean or fessing up. the cops asked all of us to come and give a statement, which i did, and they said if no one comes clean, then they are going to charge everyone with disorderly conducts and felonies. the damage to the course and carts are in excess of $18000.00 w/ labor etc... so, how can they charge all 15-18 people if no one comes clean w/ felonies? can they? or are you they just trying to scare everyone? what would happen if no one comes clean? what can i expect. all i did was drive one around on some cart paths and return.

Re: criminal mischief

They can charge you but that does not mean that you will be convicted. However, if they do charge all of you will want to hire an attorney because they are charging you with felonies.

Re: criminal mischief

Whether you are charged will depend on what you admitted to the police and what others said in their statements to the police. It sounds to me as if the golf course is inflating their damages a bit and threatening criminal prosecution to force a civil settlement but if they can convince the police to file charges you may be facing a problem.

Re: criminal mischief

It sounds to me as if you will probably be charged regardless, especially if you were part of a group that conspired to go joyride, you could be found jointly and severally liable. You may need to retain private counsel for the criminal and the civil actions. Feel free to call our offices or e-mail me directly for a free consultation.
