Legal Question in Criminal Law in Pennsylvania

domestice dispute

i pressed charges on my boyfriend for hitting me. he was bailed out of jail and we cant have any contact until the preliminary hearing. I would to ask the judge to drop the charges under the conditions that my boyfriend gets some kind of alcahol rehab and counseling. How do i go about doing this? And what are the chances of them dropping the charges?

Re: domestic dispute

If your boyfriend has no prior record, and you were not badly hurt, then many jurisdictions have programs that would apply. The D.O.I.T. program in Philly is specially designed, for example, to do just as you want. ARD is often available in other counties in Pennsylvania.

If your boyfriend has priors, it is unlikely in my opinion that the district attorney would agree. It is the DA, not the judge, that makes these decisions. I recommend calling the DA's office on the phone before the hearing. Unfortunately, the DA often lies to victims of domestic abuse so that the victims come into court and the DA doesn't have to drop the charges.

I realize my answer may not help you very much, but I'm trying to answer your question fully and honestly. I'm sorry that you're going through these troubles and I hope that you come out of this situation alright.

Let me get this straight, your boyfriend beats on you to the point the police are summoned and criminal charges are filed, yet you only wish him to seek counseling. To be quite honest, you shouldn't see him again EVER, and you should also seek mandatory counseling. IT IS NOT NORMAL TO BE HIT AND BE ABUSED WHETHER PHYSICALLY OR VERBALLY BY SOMEONE WHO ALLEGEDLY LOVES YOU!

Instead of helping him you should be helping yourself. This man is only a boyfriend, not finance, not your husband, however, even if he was the any of these persons you should still leave them, immediately. Previous counsel was correct with their legal advice, however, you of all people need to seek help.

Be advised sooner or later if this relationship continues, either you will be killed, severely injured, or facing criminal charges yourself. I've seen it time and time again, you are the first person in a relationship like, nor the last, however, It is time you take responsibility for your actions and mistakes and the biggest mistake is staying with this loser.
