Drug Arrest

My son took herion and od. His friend gave him cpr and call 911. Police and paramedics came they revived him and let him go. Police did not arrest. Later he received a summons and could not appear as he is in military and had been deployed to Iraq. I called and wrote the magistrate but he said the office did not care and wanted the hearing. I went to hearing and they have put a bench warrant out for his arrest. If they didn't arrest him in the beginning why the hearing and bench warrant?

The police may file charges within two years of an incident in most cases. The bench warrant was for failure to appear at the hearing. Given that they were aware that his failure to appear was not of his own choice, it seems kind of unreasonable that it was handled in this manner.
