Legal Question in Criminal Law in Pennsylvania

Drug related offenses

My son is in jail for burglary,receiving stolen goods,breaking probation,writing bad checks,ect.He had a preliminary hearing and was court ordered to 6 mnths. drug rehab.I got him into a rehab center out of county,would he be able to go? I would bail him out and take him,but I don`t want him violating probation by being there.He would be there for the longest-3 mnths. then in a halfway house for 6-12 mnths.I would also go get him for his trial Feb.15. Would he or I have to make arraingements with the pre-trial services or the probation office?

Without reviewing your son's record and priors it would be difficult to offer the necessary advice, I recommend consulting with an attorney who could try to work a deal with the District Attorney's Office.

#1 - With the problems your son has YOU CAN NOT HELP HIM. Only HE can help himself. You also want him to take responsibility for himself. All you can do is offer him the opportunity to help himself, but even that is hard to do without being an "enabler" - someone who allows him to continue his destructive behavior.

#2 - If your son has been evaluated, and they say he would benefit from rehab, they generally do not care where, as long as it is an approved facility, or can be approved. Your son should have an atty. If he can not afford one, a public defender. PD's usually have a LOT of criminal experience, and know everyone in the drug evaluation and rehab end. Get to the prisecutor with the rehab contact information, and ask if they will approve his going there for treatment.

Good luck, and DO NOT keep bailing out your son, or he will never help himself, and he may take you down with him!!!
