stealing from work

i was caught stealing 10 dollars out of the cash register for gas money, since i had used a quarter tank of gas for work that day. Additionally i was caught stealing a product that had the potential to be sold for 50 dollars, even though they only paid 10 dollars for the item. I have already stopped working there, for other reasons, and am awaiting my final paycheck. However, the boss asked to talk to me before they give me my paycheck. Can they hold my check from me because i stole from them?

you can get arrested for stealing the items. beware. as far as them holding your check goes, you could sue them in small claims court for the amount owed to you.

Brian is correct, but WHY were you stealing? If you work there and want really just want gas money, you ASK for a $10 advance to get gas. If I were them, I'd reasonably assume you had been stealing the whole time you were there, which is probably true, and not give you a thing. If you really have the balls to sue them for your pay, go ahead, but if I were them, I'd file criminal charges if you sued me. If you have a brain in your head, you'd go to the employer, apologize, tell them to keep your pay. Perhaps he will think better of you, and not file charges or bad mouth you when he has the chance in the future. Grow the hell up and treat others they way YOU want to be treated!

Look, your efforts to make yourself look better fall flat. Are people normally allowed to just grab money out of the register to cover expenses? Probably not. So you knew it was wrong. Then you try to argue that the wholesale value of the object you stole should apply instead of the retail value. It doesn't matter, and a court won't listen to that. You may be entitled to your paycheck under the Wage Payment Collection Law. However, your other potential charges will outweigh whatever your paycheck is.
