Migrated Disposition?

A few years back, I was charged with something that caused me to end up on PA's ARD program. My understanding was that because I was put on ARD, the actual charges would never show up on my criminal record. However, I found them on a popular free criminal search site online. Additionally, under the Disposition section of each charge, it states ''Migrated Disposition''... What does that mean? It seems I cannot find an answer anywhere.

It may be a mitigated disposition. You must file a petition to expunge the record. This order of Expungement is than circulated to the reporting agencies and you record should be cleared.

This is a murky area of Pennsylvania Law. The statutes governing expungement indicate that certain matter is public record (Magisterial District Judge) dockets but the expungement forms (at least in Allegheny County) have you list the Magisterial Docket Number. So far most of the ARD cases that I've seen still show the Magisterial Docket on UJS Portal which is probably the web site that you're looking at.

I've tried to find information on "migrated disposition" and my best guess is that it means that the case was placed into ARD or another program such as PDQ. I'm not positive of this however, because I've been unable to find anything definitive.

Your best bet is probably to go through filing a motion for expungement.
