Legal Question in Family Law in Pennsylvania

Does my business count toward my husbands child support?

I am married to my husband and I have my own business. We file taxes together but he has nothing to do with my business everything is in my name. Does that count toward his child support? His ex seems to think she is intitled to it but we keep telling her it is my business. Plus me and my husband have 2 kids together. Please help.. Thanx

While there is a formula for child support under PA Rules of Civil Procedure 1910.16-5 the trier of fact (judge) consider (b)(3) other income in the household (b) (5) assets of the party.

So the judge could consider your income though not directly. The key is that your income could be considered it doesn't have to be. Its up to the judge.
