Legal Question in Family Law in Pennsylvania

False phyical abuse acusation in divoice case

What is a father's legal right when wife accuses him of physical abuse. This is the first time in middle of nasty divorice so she gains the upper hand... Wife filed false claim that she is afraid of husband and is keeping father from seeing or calling the children... Is this possible if there is no proof and if phyical abuse just came up at the right time??? She called the cops and lied. What can father do?? What are his rights? Can he not see his children because she is upset about the divorice and not thinking right???

It is sad but often allegations of physical abuse are used in custody and divorce proceedings to gain an upper hand. If you do not have an attorney you need to get one right away. PFA actions or criminal charges can have devestating im[acts on custody cases. A lawyter will be able to prepare the necessary motions to force action on your case and secure visitation with your children. I offer free consultations.
