Legal Question in Family Law in Pennsylvania

My ex husband seems to think its ok to take my daughters phone away from her when she is with him on the weekends. I have supplied this phone for her because I would not have resonanle access to her at all if I didn't. He did this because her step father sent her a text message and my ex feels threatened by that for some reason.

Also, I have tried by calling the state police and reported him with drinking and driving with my daughter in the vehicle by telling them exactly where he is. They never did anything. Does she have to get hurt before something happens?

I live in the state if PA.

The taking of the phone is a tort, trespass to chattels and is possibly a contempt of the custody order.
