Legal Question in Family Law in Pennsylvania

My maiden name is Smith I married a Smith whom I wasn't related to and I never had my name legally changed to his name since my name is the same now I am currently divorcing him And will be having a baby soon before our divorce is final, since I have my maiden name can I legally chose my baby's last name on his birth certificate to be the last name of his father? even though I'm married to another man?

Your name doesn't matter. What might is what the child to be father wants.

That said the legal requirement for a person's name is to have a first and last name. What those are are between you and the child's father.
