power of attorney over minor child

if the biological father of a minor child under 18 years of age grants power of attorney to his wife while actively pursuing custody, does bio mom have recourse?

Yes BUT even though father's agent can undertake a law suit on his behalf the fly in the ointment is that dad is a very necessary witness. Further a court might not takes father's claim as seriously if he doesn't pursue it himself.
