Signing Over Parental Rights In Lancaster, PA

For the past two years my husband has not been allowed to see his now 7yr old son. The mother is receiving $273.65 every two weeks in child support. The mother refuses to work things out with my husband. Is there any way that he can sign over his rights to her and stop paying child support for his son? Or have her fiance adopt his child?

Does the other man want to adopt his son?

Has your husband sought a visitation Order?

Without an pending adoption he can not terminate his parental rights. You would be asking the court to make the child an orphan and they won't do that.

Nor is expecting the fiance to adopt the child prior to marriage does not fly either as mom would be terminating her parental rights as well. That's why I advise a mom in that situation to wait till after she marries before going for an adoption.

That said if mom won't let dad see the child his remedy in the courts. He does have rights to see his child but absent a custody order he has no way of enforcing them.

It would be sad for dad to just walk away from his son.
