The amount of spousal and child support in Pennsylvania is primarily based on income. The amount of support may be modifiable if the income of the parties increases or decreases after the original award of support. Other factors that the court may consider are the amount of over-night custody time that each party spends with the children, extraordinary expenses and whether a party has an earning capacity that exceeds their income. If you believe that you are entitled to a modification of support, I would recommend that you discuss these issues with an attorney or with the domestic relations division of your local county court of common pleas. You will want to act quickly: a modification of support may only be retroactive back to that date that you file your request for modification with the court. You may lose valuable rights if you procrastinate.
