business owner duties to consumers

I was entering an unfamiliar gas station after dark. Large pot holes were disguised by water and they were no visible after dark. Entered property which is on an incline and damaged the front end of my vehicle. Reported it to store employees who stated that there have been several complaints. Tried to resolve with business owners, now I've intiated a civil suit against them at the magistrate level.

What are there duties to consumers?

A landowner has a duty to warn against hidden defects in the property that a person would not discover by exercising due care. The fact that the gas station had previous notice of the condition is very helpful to you, because it provides him with notice. Make sure you bring photographs to the magistrates hearing. Sounds like you have a good case.
